The CONSERVATOIRE NATIONAL SUPERIEUR DE MUSIQUE ET DE DANSE DE PARIS (hereinafter referred to as the "CNSMDP") in partnership with IRCAM, Saint-Étienne's Jean Monnet University and Paris 8 Vincennes-Saint-Denis University (hereinafter collectively referred to as the "Project Owners") has developed a collaborative web platform for archiving electronic music. This platform is intended for the institutions behind its creation, as well as partner universities, cultural organisations, music education establishments, and creators and performers (both French and foreign) (hereinafter referred to as the "Partners"). It is known as the "ANTONY Platform" (hereinafter referred to as the "Platform").
The Project Owners have set up an editorial committee comprising representatives from each of the Project Owners whose main role is to administer and manage the Platform (hereinafter the "Editorial Committee").
The ANTONY Platform allows users who hold an account on the Platform and is duly authorised to make a deposit to reproduce and publish metadata on the Platform, thereby facilitating the digital preservation, archiving and storage of the works and content deposited. The following, in particular, may be deposited: sound recordings and computer files relating to the works ("patches"), musical scores, live recordings, photographs, technical diagrams, programme notes, recordings of the instrumental part used as a simulation for playing the electronic part, recordings of processing as an audio reference for the version, etc. (hereinafter collectively referred to as the "Content").
The ANTONY Platform can be securely accessed online in France and worldwide. It is available free of charge for viewing, downloading and/or streaming, subject to authorisations granted by the Editorial Committee. Its primary target audiences are researchers, teachers, students, creators and performers wishing to perform the works, as well as the general public where appropriate.
The ANTONY Platform is open to the public for viewing purposes only. Access for the purpose of submission is restricted to users who have created an account on the platform in accordance with the terms of Article 2.2 below (hereinafter referred to as "Submitters"). Access to all uploaded content relating to a version of a work, as well as the editing of metadata concerning that version on the platform, is restricted to the Submitter and users who have obtained specific authorisation from the Submitter of the corresponding version ("collaborative mode"). Finally, access to content specifically required for a work to be replayable is restricted to users who have obtained authorisation from the Editorial Committee in agreement with the work's rights holders. In such cases, a temporary download link is provided to them (hereinafter referred to collectively as "Users").
All Users of the Platform must comply with these terms and conditions of use at all times (the "Terms of Use").
These Terms of Use set out the terms under which users can access and use the ANTONY Platform.
Any User accessing the Platform undertakes to comply with these Terms of Use without reservation prior to using or registering on the Platform. This acceptance must be full and unconditional.
The Project Owners reserve the right to amend or remove these Terms of Use at any time, at their sole discretion and without prior notice. These Terms are subject to change at any time, particularly to reflect any legal, case law, editorial and/or technical developments.
By logging in to the Platform, any User is deemed to have accepted the Terms of Use and any subsequent amendments without reservation. The prevailing version of the Terms of Use is the one available online on the Platform at the time of login. All users are therefore required to refer to the version available online on the date they access the Platform. Any User who does not agree to all or part of the Terms of Use or any amendments to them must cease all use of the Platform immediately. Continued use constitutes tacit acceptance of the Terms of Use or any amendments.
The Project Owners grant all Users a free, non-exclusive licence to use the Platform's software, in accordance with the provisions of the GNU Lesser General Public Licence (GNU LGPL) version 3, a copy of which is available at https://www.gnu.org/licenses/lgpl-3.0.html#license-text, or any subsequent version published by the Free Software Foundation.
The rights to use, reproduce, modify and redistribute the software of the Platform (excluding its Content) are governed exclusively by the terms of this licence. The licensee may not impose any additional restrictions or grant any sub-licences that contravene the provisions of the GNU LGPL.
Use of the Platform's services and Content is subject to acceptance of, and compliance with, these Terms of Use.
By accepting these Terms of Use, Users confirm that they have the full legal capacity required for this purpose.
In order to upload Content to the Platform and access Content made available via the Platform, any User must register and open a User Account.
Registration is open to individuals aged 18 or over who have the legal capacity to enter into a contract under these Terms of Use. Account creation is subject to approval by the Platform's Editorial Committee, who will assess whether the reasons given by the User in the registration form align with the purposes of the Antony Platform.
When creating a User Account, the User must complete a registration form available on the Platform at https://antony-archiv.org/register, which involves the collection of metadata that enables the User account to be automatically identified. This metadata includes:
By declaring an affiliated entity on the registration form, any User warrants that they are expressly authorised to act on its behalf and under its authority.
In order to register, any User must have read and accepted these Terms of Use and Antony's user documentation.
The Editorial Committee then receives an email requesting registration to the Platform. Registration requires manual approval by a member of the Editorial Committee.
The Editorial Committee has complete freedom to accept or reject any registration on the Platform. In the event of rejection, the Editorial Committee is under no obligation to provide an explanation or compensation.
Upon registration, each User undertakes to provide true, accurate, up-to-date and complete information regarding their identity, as well as the identity of the employer or entity they represent or are affiliated with. In particular, they undertake not to create false identities that could mislead the Editorial Committee or other Users, and not to impersonate any other legal or natural person.
Each User confirms that they have the necessary authority to register on the Platform and use its services and features. Each User indemnifies the Project Owners and Partners against any claims, actions or complaints relating to this.
In general, if the User provides false, inaccurate, out-of-date, incomplete or misleading information, or information that is likely to mislead, their User Account may be suspended or terminated with immediate effect, either temporarily or permanently, without prior notice or compensation.
A User's registration on the Platform is deemed to have taken place on the date that their Account is opened.
Once the Editorial Committee has approved the registration application, the User will receive a confirmation email granting them access to the Platform. This email will contain the login details that the User entered in the registration form.
The Project Owners reserve the right to modify the Platform, its services and features, either partially or fully, without prior notice. This includes, but is not limited to:
(i) The right to amend the conditions of access to the Platform;
(ii) The right to stop providing, or stop developing, all or part of the Platform, its services and features, either temporarily or permanently;
(iii) The right to take the necessary measures against (a) any use of the Platform that may reasonably be interpreted as an infringement of the intellectual property rights of Project Owners, Partners or third parties; (b) the dissemination of internet viruses, worms, Trojan horses, malware; and/or (c) any other activity that is harmful to the Platform or unlawful.
Users will be notified of these changes via email and/or a banner displayed when they log in to their account. If a user does not accept a change, they must stop using the Platform immediately and notify the Editorial Committee of their intention to close their Account.
The Project Owners shall not be liable to the Users or any third party for any modification, suspension or interruption to the Platform, its services or features, whether in whole or in part.
Each User is responsible for keeping their Login details confidential and for any use made of them. Users undertake to keep these Login details secret and not to disclose them in any form whatsoever. These Login details must not be shared or used by more than one person.
The Editorial Committee reserves the right to delete Login details if there are reasonable grounds to believe that they have been used by an unauthorised third party, or by a user in breach of the Terms of Use or applicable laws and regulations.
Each User must notify the Editorial Committee immediately of any actual or suspected disclosure, loss or unauthorised use of their Login details. The Editorial Committee may then be asked to cancel and/or update these Login details.
Any access to, use of or transmission of data carried out via a User's Account shall be deemed to have been carried out by that User, and any use of the Platform via that User's Login details and account shall be binding on that User. Users are solely responsible for keeping their passwords confidential.
Users are required to log out of the Platform at the end of each session, especially if they are using a public computer.
The User is solely responsible for any loss, misappropriation or unauthorised use of their Login details, and for any consequences thereof.
Users acknowledge that, in the circumstances referred to above, the Editorial Committee has the right to take all appropriate measures to ensure the security of the Platform.
Any User of a User Account is regarded as the Administrator of that Account.
Free technical support is available to all Platform Users, including those without a user account, via the contact form in the "Contact" tab on the Platform or at the following address: https://antony-archiv.org/contact.
Users may only use the Platform and the Content available on it within the scope, by the means and for the purposes authorised in these Terms of Use and/or the applicable laws and regulations. Accordingly, no user may:
(i) use all or part of the Platform or its Content to carry out any unlawful activity or breach any applicable law or regulation, nor to incite or encourage others to do so;
(ii) copy, duplicate, distribute, modify, adapt, pirate or create derivative works of the Content without the authorisation of the rights holders of that Content;
(iii) provide false, inaccurate or misleading information;
(iv) act in a manner that is defamatory or contrary to the legitimate interests of Project Owners, Partners and/or other Users, or more generally, any person;
(v) use all or part of the Platform or its Content without agreeing to be bound by these Terms of Use.
The Editorial Committee reserves the right to remove any message posted by a User that misuses the Platform. In the event of a repeat offence, the User Account of the User concerned may be suspended or deleted.
The User assumes all risk of using the Platform.
In particular, Project Owners shall not be held liable for any incident arising from Users providing incorrect or incomplete information, nor for any wrongful or fraudulent conduct on the part of Users.
Users are solely responsible for their activities and use of the Platform, in accordance with applicable laws and regulations and these Terms of Use.
The Editorial Committee reserves the right to permanently remove any information or Content posted on the Platform that is reported as being unlawful or in breach of applicable laws and regulations. This information will be reviewed retrospectively.
The ANTONY Platform is available 24/7, except during the following periods:
(i) Scheduled maintenance outages, or
(ii) Interruptions caused by circumstances beyond the reasonable control of the Project Owners, such as force majeure, an act by an administrative or government authority, flooding, fire, earthquakes, civil unrest, acts of terrorism, pandemics, strikes, internet service provider failure, or cyberattacks despite the cybersecurity measures put in place to prevent malicious acts.
Project Owners may use subcontractors to provide the Platform and its associated features and services.
Project owners shall implement and maintain administrative, physical and technical safeguards to protect the security, confidentiality and integrity of the Platform. These security measures are particularly designed to prevent unauthorised access to, use of, modification of, or disclosure of Content available on the Platform.
Project Owners act exclusively as coordinators of the Platform.
Project Owners are therefore under no obligation to achieve specific results.
Project Owners shall not be held liable, either directly or indirectly, for the proper use of the Content via the Platform for any reason, and no compensation of any kind may be claimed on this basis.
Project Owners will use their best endeavours to ensure that Users have access to the Platform at all times. However, the Project Owners shall not be held liable for any reason whatsoever if the Platform and/or the Content are unavailable.
Users acknowledge that they have the necessary skills and resources to access and use the Platform and confirm that they have verified that their computer system is virus-free and in full working order.
The Project Owners cannot guarantee the accuracy, comprehensiveness, completeness or timeliness of information posted by Users on the Platform. They also cannot guarantee that the platform will always function properly or that it is completely secure.
Due to the nature of the internet, the Project Owners cannot guarantee that Users' Accounts will operate without interruption or error, or that they are free from viruses or unauthorised access. They do not accept any liability in this regard.
The Project Owners make no express or implied warranties, including, but not limited to, those relating to the continuity of the Platform, the performance of the Platform, its services or features, the longevity of the Platform, its services or features, the suitability or compatibility of the Platform, its services or features for a specific purpose, the quality or freedom from defects or faults of Users' Accounts, or the suitability of the Platform for a particular purpose.
The Project Owners make no express or implied warranty regarding the continuity or long-term preservation of data and Content provided by Users. Users are advised to keep a copy of their own data and content.
The Project Owners do not guarantee transfer rates or response times for information transmitted from the platform to the internet. Users acknowledge that the speed at which information is transmitted depends on the characteristics of electronic communication networks and their connection method (PSTN, cable, ADSL, etc.), rather than the Project Owners. Users acknowledge that they use their user account at their own risk. User accounts are provided 'as is' and are accessible without any guarantee of availability or reliability.
Users acknowledge that Project Owners shall under no circumstances be held liable for:
any damage that a User may suffer as a result of another person using their login details and/or User Account, whether or not the User was aware of such use;
any damage resulting from the disclosure, loss or unauthorised use of Login details by Users;
the creation, modification or deletion of data, or the failure to receive, send or transmit data, is the sole responsibility of the Platform's Users;
the use made of the content by each User, which is the sole responsibility of each User;
the consequences resulting from any loss of Users' data;
the consequences of a third party accessing a User's Account or any damage to equipment arising from and/or during use of a User Account, particularly when Users access the Platform using technical tools that are not compatible with the Platform;
any interruption to the Platform, regardless of the cause, duration or frequency, in particular due to breakdowns or maintenance work necessary for the proper functioning of the Platform;
the behaviour and actions of Users;
in the event of a user's inability to use or access the Platform;
the consequences of any viruses, bugs or technical faults, or any damage to equipment arising from or during use of the Platform, its services or features;
any amendment to the Terms of Use or any modification to the Platform;
the deletion, alteration or failure to store Content made available by Users;
more generally, this includes any event beyond the control of the Project Owners.
Any User with a User Account in accordance with the terms of Article 2.2 above may upload and make Content available on the ANTONY Platform in the area designated for this purpose.
In this context, each User must ensure that they only make available Content of any kind on the Platform for which they hold valid authorisation from the relevant rights holders (authors, performers, etc.) and the necessary authorisation for publication from their affiliated organisation.
In general, each User warrants that any Content they make available: (a) does not infringe, violate or misappropriate the rights of any third party, including any copyright, trademark, patent, trade secret, moral right, right to privacy or right of publicity; (b) does not breach any law or regulation applicable to the User's country and/or the ANTONY Platform; and (c) does not require the obtaining of any licence from a third party or the payment of any fees or royalties.
Each User is solely responsible for the Content they publish online, as well as the consequences of doing so via the Platform.
Each User is particularly responsible for ensuring that:
(i) they shall not create, transmit, post or make available any Content that breaches these terms of use, the Platform's rights and/or the rights of other Users and, more generally, the rights of any third party;
(ii) such Content is not harmful (in particular, it does not contain computer viruses, malware or other destructive code), or otherwise unlawful under the law of the User's country of residence and/or the regulations applicable to the Platform; and
(iii) it holds the necessary rights to use the Content for each of the uses it authorises on the Platform.
Each User therefore indemnifies the Project Organisers, the Partners and, more generally, any other User against any claims, recourse or legal proceedings by any third party relating to the Content made available on the ANTONY Platform.
Users undertake to defend, indemnify and hold harmless the Project Owners, Partners and other Users against any claim, loss, damage or liability arising directly or indirectly from any breach by Users of these Terms of Use, including the representations, warranties and undertakings set out therein.
Each User who makes Content available on the ANTONY Platform specifies the permitted uses they grant for that Content (viewing, listening, authorised or unauthorised downloading) by selecting the relevant features provided by the ANTONY Platform.
Users acknowledge that the use of the information and tools available on the Platform is their sole responsibility.
Each User expressly undertakes to comply with the rules of use defined for each item of Content by other Users. Any failure to comply with the relevant rules may result in a report, which may lead to the permanent exclusion of the User concerned, without prejudice to any legal remedies that may be pursued by another User whose rules of use have not been complied with.
Commercial use of the Content available on the Platform is strictly prohibited without the authorisation of the rights holders of such Content.
The accuracy of the information published is the sole responsibility of the Users making the Content available.
Each User is advised to carefully and regularly review what they transmit, submit or publish (or arrange for to be published) on or via the Platform. Each User understands that all published information and Content is the sole responsibility of the person from whom such information and Content originates. Each User is therefore fully responsible for all information that is uploaded, published, transmitted or otherwise made available on or via the Platform with their authorisation, and neither Project Owners, Partners nor other Users may be held liable by any party in this regard.
No User shall use the Platform in any manner that is prohibited by the laws and regulations in force applicable to the User and/or the Platform, or that contravenes these Terms of Use.
As the ANTONY Platform is collaborative in nature, no moderation, monitoring or prior filtering of Content is carried out. However, any User who becomes aware of unauthorised use of the Content they have made available and/or use that contravenes the rules of use they have defined may report this to the Editorial Committee by completing the contact form available in the 'contact' tab on the Platform or by emailing https://antony-archiv.org/contact.
A verification procedure will be carried out in response to this report by the Editorial Committee and/or the Project Leaders, who may launch an investigation into the User in question after notifying them.
A User subject to a complaint may have their User Account temporarily suspended, pending the resolution of the dispute and/or have their access to the Platform permanently suspended if the dispute remains unresolved or in the event of proven use that contravenes the rules governing the use of the Content in question, without prejudice to any legal remedies that may be pursued against the User who has failed to comply with the rules of use.
Any information or Content available on the Platform may be disclosed by Project Owners at the request of administrative or judicial authorities, in particular for the purposes of investigating, establishing and prosecuting offences, or for the handling of complaints.
The ANTONY Platform, including its user interface and features, is protected by copyright laws, as well as all other laws relating to intellectual property and property rights. The terms and conditions governing the use of all or part of the Platform's software are set out in Article 2.1 above.
Access to and use of the Platform may be terminated at any time and for any reason, as follows:
(i) by any User, by completing the contact form available in the 'Contact' tab on the Platform or at https://antony-archiv.org/contact;
(ii) by a Project Leader, by notifying the User via email and/or a banner displayed when the User logs into their Account, in particular where the Editorial Committee, a Project Leader or a Partner has revoked the access authorisation originally granted to a User;
(iii) at the request of a Partner acting on its own behalf or on behalf of Users affiliated with its organisation.
Termination shall not give rise to any entitlement to compensation or damages.
In the event that a User's access to the Platform is terminated for any reason, their Account will be deactivated as soon as possible and the User must cease using the Platform and prevent any further use of it.
Access to all or part of the Platform or to an Account may be suspended at any time, either temporarily or permanently, due to: (i) a breach or alleged breach of these Terms of Use; (ii) legal or regulatory obligations; or (iii) measures taken to protect the integrity, operability or security of the Platform.
Unless prohibited by law, or in the context of legal proceedings, or to prevent imminent harm to the Platform or a third party, such a suspension will be notified by email sent to the User concerned and/or via a banner displayed when they log in to their Account.
No compensation shall be payable in respect of any suspension, whether temporary or permanent.
Project Owners and Partners act under these Terms of Use as entities independent of one another.
Each User of the Platform acts on their own behalf or on behalf of the entity to which they are affiliated, or under the direction and instructions of that entity.
These Terms of Use shall not be construed as creating any form of legal association between Users, Project Owners and Partners.
If any provision of these Terms of Use is deemed invalid, or is declared as such pursuant to a law or regulation or following a final decision by a competent court, it shall be deemed not to have been included, without this rendering the other provisions null and void or affecting their validity; the remaining provisions shall remain in full force and effect.
Project Promoters shall then be entitled, where appropriate, to replace the clause declared null and void with a clause which, as far as possible, most closely approximates the content of the clause originally agreed and the original overall balance.
No User may, directly or indirectly, in whole or in part, by operation of law or otherwise, assign, delegate or transfer the rights and obligations under these Terms of Use to a third party. Any attempt at assignment, transfer or delegation shall be null and void and unenforceable against the Project Owners.
Project Owners may freely assign or transfer the rights and obligations arising from these Terms of Use, or delegate any of their rights and/or obligations under these Terms of Use, without restriction, to any third party of their choice.
Any failure by either Party to exercise or enforce any provision or any of its rights under these Terms of Use shall not be deemed a waiver of the future enforcement of that provision or right.
The provisions of these Terms of Use are governed by French law.
Any disputes that may arise concerning the interpretation, performance or validity of these Terms of Use, and which cannot be resolved amicably, shall be submitted exclusively to the competent courts of Paris.
In the event of any difficulty in interpretation, the French version of these Terms and Conditions shall prevail.
